Andrew Baugher Quoted in Virginia Lawyer’s Weekly on Recouping Cost of Private Process Servers
Andrew Baugher was recently quoted in a Virginia Lawyer’s Weekly Article, “Door May Be Closing on Fee Issue” regarding district court federal judge’s in the Eastern and Western district declining to award costs to defendants for private process serving fees:
Harrisonburg lawyer Andrew S. Baugher, who represented the hospital in Scates, pointed out to the court that a clear majority of federal courts of appeal recognize private process server fees are taxable against the losing party…
And lawyers may have good reason for using the private method, according to Baugher.
“Sometimes the issue is speed in getting documents served,” Baugher said, or issues in service out of state. Using the private alternative may be easier for staff to coordinate, “particularly when you don’t know the local practice or time frame,” he said.
