Richard Howard-Smith Writes on “Disrupting an Estate Plan”

Richard Howard-Smith recently wrote an article entitled “Disrupting an Estate Plan” which was published in the Fall 2018 Newsletter of the Virginia State Bar’s Trusts and Estates Section. Richard offers his comprehensive analysis of the ways in which a client’s intent may be thwarted by techniques that many attorneys rely on for post-mortem planning, including disclaimers, trust modification and termination, and decanting. Richard’s article also illustrates the dichotomy between achieving the client’s wishes and maintaining flexibility for unforeseen circumstances.
